The Supreme Court Collegium has put forth its recommendation to appoint two judicial officers, Biswajit Palit and Sabyasachi Datta Purkayastha, as Judges of the High Court of Tripura. This proposal stems from the initial recommendation made by the Acting Chief Justice of the High Court of Tripura, in consultation with two senior colleagues, on December 1, 2022, advocating the elevation of these judicial officers to the esteemed position of High Court Judges. Notably, the response from the Chief Minister and Governor of Tripura regarding this recommendation was pending. In accordance with the Memorandum of Procedure, the Department of Justice invoked para 14, which allows the Minister of Law and Justice to assume that the State constitutional authorities have no further input if their comments are not received within the stipulated timeframe.
The Collegium thoroughly scrutinized the candidates' fitness and suitability for this elevation, consulting with colleagues knowledgeable about the High Court of Tripura's affairs. They meticulously assessed the materials provided, including observations from the Department of Justice and any received complaints. The Government of India's input on the matter did not contain any adverse information regarding the candidates' reputation or integrity. Additionally, the Collegium acknowledged the Judgment Assessment Committee's report, which found the candidates to be suitable for the position. The Collegium also took into account the non-recommendation of senior judicial officers, based on cogent reasons put forth by the High Court Collegium. Consequently, the Supreme Court Collegium has resolved to recommend Biswajit Palit and Sabyasachi Datta Purkayastha's appointment as Judges of the High Court of Tripura, with their inter se seniority to be determined according to existing practices.
