Tripura High Court Upholds Dismissal of 10,323 Teachers, Imposes Fine on Petitioner
In a significant development, the full bench of Tripura High Court, consisting of Chief Justice AK Singh, Justice T Amarnath Gaur, and Justice Arindam Lodh, has once again upheld the dismissal of a petition filed by one of the retrenched 10,323 teachers. This legal battle, ongoing since 2014, has seen a petitioner challenging their termination.
Contention Over Teacher Termination
Advocate General Siddharta Sankar Dey explained that the petitioner argued that they were not a party to the initial petition in which the High Court had invalidated the recruitment rules used for these appointments. The petitioner contended that their services should not have been terminated as they were appointed during the previous government's tenure. They claimed that the termination lacked proper notice. The government, on the other hand, argued that they had not terminated anyone but rather that the entire selection process was fundamentally flawed. The Court's ruling aligned with the government's stance, stating that all the 10,323 teachers were liable to be terminated due to the flawed recruitment process.
Dey further elaborated that the government had repeatedly sought extensions from the Supreme Court to accommodate the terminated teachers because they couldn't immediately fill the vacant positions. These extensions were granted in phases until March 2020.
Dismissal Upheld, Fine Imposed
The Court's decision rested on the fact that the petitioner failed to introduce new arguments and could not justify their continued employment, despite the previous government's recruitment policy being declared unconstitutional in previous judgments by both the High Court and the Supreme Court. In response to the misuse of judicial time, the Court imposed a fine of Rs 25,000 on the petitioner.
This ruling reaffirms the termination of the 10,323 teachers and settles a long-standing legal dispute surrounding their employment status.
